It has the same legal validity as the handwritten signature but with greater security because it is impossible to forge, it is unique and different for each document
Although the institutional framework for the introduction of the digital signature exists since 2001 and its use significantly improves the times required for the exchange of documents and the processing of various transactions in the public and private sector, with great economic benefit, its adoption is still relatively limited in our country.
The digital signature is our footprint in the modern world. A unique code that uses asymmetric public key cryptography and ensures the authenticity of the sender, proving the authenticity of documents and messages.
Anyone can digitally sign a document for many of the same reasons they would sign a paper document. The use of digital signatures can drastically reduce the sending of printed documents authenticated in the traditional way, i.e. using stamps and signatures.
In addition, the digital signature ensures:
- Confidentiality: protection of data from unauthorised access.
- Integrity: protection of data against unauthorised modification or replacement.
- Authentication: confirmation of the sender's identity.
- 'Do not refuse acceptance': The sender of data cannot refuse the message.
It has the same legal validity as a handwritten signature but is more secure because it cannot be forged, is unique and different for each document. After the digital signature, the content of the document is protected, cannot be modified and cannot be denied.
It is noted that the digital signature is mandatory for companies that want to participate in public tenders over 60,000 euros, through the electronic platform of ESIDES. It also applies to a wide range of professionals and businesses, such as lawyers and judges (filing of cases electronically), doctors and pharmacists (e-prescribing), notaries, accountants and tax advisors and companies in general aiming to ensure the security of their documents and transactions.
